ISARD SHOES LTD., o/a THE SHOEBOX , is a corporation incorporated in the Province of Ontario, operating under the business name “The Shoebox” in the City of Sarnia, in the County of Lambton. The Shoebox (the “Company”) is an independently owned retail shoe store. A customer (the “Client”) may make purchases by visiting the store in-person or online (the “Service”) through the website: shoeboxsarnia . ca .
The following Terms and Conditions and Privacy Policy outlined below will be accepted and legally binding upon any clients of The Shoebox. Please read these Terms and Conditions and the Privacy Policy carefully as they contain important information in regards to your legal rights, remedies and obligations.
TERMS AND CONDITIONS - The Terms and Conditions apply to all visitors and users of the website. - By accessing and/or making a purchase through the website you acknowledge you have read, understand and agree to be bound by these terms and conditions. - The Shoebox reserves the right, at our discretion to change, modify, add or delete portions of these Terms and Conditions at any time; by accessing or using our website you acknowledge and agree to any changed or modified terms moving forward.
PRIVACY - The Shoebox is committed to protecting your privacy whether through accessing the website, opening an account, and/or making a purchase, and uses reasonable efforts to protect same. The Shoebox may only collect personal information that is specifically authorized at law, or where the collection is necessary to provide the Service. - By providing personal or billing information you consent to collection of same by The Shoebox. Order Information includes the name, billing address, shipping address, payment information, email address and phone number. - Order Information is collected to fulfill purchase orders placed on the website, including processing payment information and providing invoices and/or order confirmations. - Order Information will additionally be used to communicate with the client, screen orders for potential risk and fraud and if applicable, provide the client with information relating to products and services. - Unless otherwise requested to delete, The Shoebox will maintain the Order Information for record keeping purposes. - By agreeing to these Terms and Conditions, you acknowledge that you are the age of majority in your state or province. - This Privacy Policy will govern any and all transfers of data, sharing and collection of information, and use of same. - At all times, The Shoebox follows the Freedom of Information and Protection of Privacy Act, Ontario, and the Privacy Act, Canada. - The Shoebox will use every effort to maintain confidentiality and respect for all clients.
PAYMENTS - All payments for in in store and online purchases will be processed through the financial services platform, Square Block Inc. or Shopify. - You agree to accept and be bound by the terms, conditions, and privacy policy of Square Block Inc. or Shopify - You agree to provide current, complete and accurate purchase and account information for all purchases made through the website and in store.. You agree to update your account and other information such as email address and credit card numbers, including expiration dates, so that transactions can be made successfully. - If your credit card is declined, the transaction will be cancelled. - In addition to the billing information provided above, The Shoebox may collect and provide information in order to manage payments, provide promotional information, meet regulatory requirements, provide other services and improve our administrative programs.
SHIPPING - Any products purchased from the website can be shipped through Canada Post or other Canadian shipping partner within 48 business hours. All shipped packages will contain a tracking number. - The Shoebox does not ship to the United States.
PRODUCTS OR SERVICES - Certain products may be available exclusively through the website. These products may have limited quantities and are subject to return or exchange in accordance with our Return Policy. - Every effort has been made to accurately display the products on our website. - All descriptions and/or pricing of products are subject to change at any time without notice at the sole discretion of The Shoebox. - The Shoebox reserves the right to discontinue any product at any time. - The Shoebox does not guarantee that the quality of any products, services or information purchased by you will meet your expectations or that any errors in service will be corrected. - All products purchased through the website are subject only to any applicable warranties of their respective manufacturers. - Occasionally, there may be typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers and availability. The Shoebox reserves the right to correct any errors or omissions, to change or update information and/or cancel orders if any information in the Service is incorrect. This will include if purchase orders have already been submitted.

The Shoebox is not responsible for the privacy practices of third parties. - The Shoebox and/or any possible third-parties may use “cookies” and/or other web technologies that collects standard information sent from your browser, in order to customize the experience.
INTELLECTUAL PROPERTY - The logos, designs, trademarks, service marks, business names, and products photos on the website are considered Intellectual Property under these Terms and Conditions. - The Intellectual Property is owned and legally protected by The Shoebox and cannot be used or implemented by an outside person or company without consent. - You are prohibited from using the website and its content for any unlawful purpose.
DISCLAIMER OF WARRANTIES & INDEMNIFICATION - The Shoebox does not warrant or guarantee that your use of the Service will be uninterrupted, timely, secure, error-free or have accurate or reliable results. - You agree that from time to time, without any explanation, the Service may be unavailable for indefinite periods of time, without notice to you. - Under no circumstances shall The Shoebox be liable for any injury, loss, claim, or any direct, indirect, incidental or consequential damages of any kind, including, without limitation, lost profits, lost revenue, replacement costs, or any similar damages, arising from your use of any of the Service or products received from using the Service, or for any claim related in any way to your use of the Service or product. - You agree to indemnify, defend, and hold harmless The Shoebox and our parent, subsidiaries, affiliates, partners, agents, licensors, service providers, subcontractors, suppliers, employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms and Conditions.
DISPUTE RESOLUTION - As The Shoebox is a business operating under the Laws of the Province of Ontario, the relationship between the client and The Shoebox shall be governed by the laws of Ontario at all times. - Should be there any dispute arising out of the Service provided by The Shoebox, or any ancillary concern, you explicitly agree that dispute resolution will be handed by arbitration.
SEVERABILITY - If a provision of these Terms and Conditions is determined to be unlawful, void, or unenforceable, such provision shall be enforceable to the fullest possible extent permitted by applicable law. The unenforceable portion of such provision shall be deemed to be severed from these Terms and Conditions. - The validity and enforceability of the remaining provisions will not be affected.
TERMINATION OF TERMS AND CONDITIONS - These Terms and Conditions are effective unless and until terminated by either The Shoebox or the client. The client may terminate these Terms and Conditions at any time by notifying The Shoebox that use of the Service is no longer desired. - If determined through the sole judgement of The Shoebox, failure to comply by the client with any of these Terms and Conditions, The Shoebox may terminate this agreement at anytime without any notice and the client will be liable for all amounts due up to and including the date of termination and/or access to the Service may be denied.
